By visiting our site, browsing, creating an account, and/or purchasing a product or service from us, you engage in our Services and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use our Services or access our website.

Section 1 - Eligibility and User Responsibilities

  1. Age Requirement:

Section 2 - Custom Projects and Client Consent

  1. Custom Products:

    • All custom projects are created specifically for and belong exclusively to the client commissioning the work. These are not made available for sale or redistribution without the explicit written consent of the client.

  2. Consent for Public Sales:

    • Custom projects will only be listed for public sale if the original client explicitly consents in writing.
    • If a client chooses not to grant consent for public sales, we will unconditionally honor this request.

  3. Exclusivity of Custom Work:

    • Unless otherwise agreed in writing, all custom projects remain the exclusive property of the client.

  4. Portfolio and Marketing Use:

    • CubiCraft reserves the right to showcase completed custom projects in its portfolio or marketing materials. However, we will only do so with the client’s prior approval.

Section 3 - Custom Design and Special Request Policy

  1. Deposit and Payment Terms:

    • For custom projects (e.g., villas, interiors, etc.), clients are required to make a 10% upfront payment of the total project cost before work begins.
    • The remaining 90% is payable upon project completion, subject to the client’s approval of the final design.

  2. Design Review and Revision Process:

    • Clients are entitled to three (3) revisions during the design process.
    • Revision requests must be submitted in writing and include clear instructions for the required changes.
    • Revisions exceeding three (3) rounds will incur additional charges, which will be communicated and agreed upon prior to proceeding.

  3. Client Approval or Non-Approval:

    • If the client approves the design after revisions, the remaining 90% payment is due, and the final project will be delivered.
    • If the client does not approve the design after the third (3rd) revision, the initial deposit (10%) will be retained by CubiCraft as a service fee, and no deliverables will be provided.

  4. Cancellation Policy:

    • If the client cancels the project after work has commenced, the initial deposit is non-refundable.

  5. Ownership of Custom Projects:

    • Until full payment is received, the design and all related materials remain the exclusive property of CubiCraft.
    • Upon full payment, ownership of the final deliverables is transferred to the client.

  6. Exclusivity and Sales Policy:

    • Custom projects will only be listed for public sale with the client’s explicit consent. If the client declines, the project will not be offered for sale under any circumstances.

Section 4 - Orders, Pricing, and Payments

  1. Order Acceptance and Cancellation:

    • We reserve the right to refuse any order for any reason, including suspected fraudulent activity, incomplete information, or violations of these Terms.
    • If we cancel an order after payment has been processed, the client will receive a full refund.

  2. Pricing:

    • Prices for our products and services are subject to change without notice. All prices displayed on the website are in [Currency, e.g., AUD].

  3. Taxes:

    • Clients are responsible for any applicable taxes based on their jurisdiction. Taxes will be calculated and displayed at checkout.

  4. Payment Processing:

    • We do not store sensitive payment information such as credit card numbers on our servers.

Section 5 - Shipping and Delivery

  2. Delivery Issues:

    • We are not responsible for delays caused by third-party carriers, customs processes, or other unforeseen circumstances.
    • If a package is lost during transit, we will work with the carrier to resolve the issue and may offer a replacement or refund, at our sole discretion.

  3. International Shipping:

    • Clients are responsible for any customs duties, taxes, or import fees associated with international shipments.

Section 6 - Returns, Refunds, and Exchanges

  1. Eligibility for Returns:

    • Custom projects are non-refundable once production has begun.
    • For general products, our return policy allows returns within 14 days of delivery, provided the product is unused and in its original packaging.

  2. Refund Policy:

    • Refunds will be processed to the original payment method within 7 business days of return approval.
    • Shipping fees are non-refundable unless the return is due to a fault on our part.

  3. Exchange Policy:

    • Exchanges are subject to product availability and will only be approved for products returned in unused, original condition.
